Introduction

These Terms and Conditions govern the relationship between Embers and its customers. By using Embers’ services or purchasing Embers’ products, you agree to these terms.

Services Offered

Embers offers custom laser engraving services and laser engraved products. Customers may be individuals or businesses. Embers reserves the right to refuse service at its sole discretion.

Account Creation

Embers is not a web development company. We use a third party for hosting our online store and associated accounts. We will never sell your information to any third party. Your information is used solely for processing orders, communication purposes, and improving our services.

Custom Engraving Services

• Customer Responsibilities: Custom engraving is dependent upon mutually agreed terms and the customer providing necessary information and images. Customers are responsible for ensuring the accuracy of all provided information and images.
• Image Quality: Images provided by the customer that are unsuitable for engraving may result in termination of the sale, rejection of the project, or additional fees for design and setup.
• Material Damage: Laser etching is a permanent process that removes material. Embers cannot guarantee against damage to customer-provided items. Customers are responsible for understanding the potential risks of laser engraving.
• Design Approval: Customers must carefully review and approve all design elements, including fonts, graphics, spelling, placement, and etching depth. Once approved, custom jobs cannot be terminated if laser etching has begun.
• Order Cancellation: If a customer cancels an order before laser etching begins, any applicable design or setup fees are non-refundable.

Product Sales

Embers sells laser engraved products. While Embers takes care to protect products during shipping, it cannot guarantee against damage during transit.

Intellectual Property

Embers is not a copyright research company. By submitting graphics or logos to Embers, the customer represents and warrants that they have the right to use the image. Any designs created by Embers remain the intellectual property of Embers and may not be reproduced or sold without Embers’ express written consent. If Embers believes a submitted image infringes on a third party’s copyright, Embers will attempt to work with the customer to find an alternative. If no suitable alternative can be agreed upon, the project may be terminated.

Disclaimer of Warranties

Embers will make every effort to ensure that products are as described and pictured. However, due to the nature of laser engraving and the materials used, variations in color, texture, and engraving depth may occur. Embers disclaims all other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Limitation of Liability 1

Embers is not liable for damages or losses resulting from the use of its services or products. This includes, but is not limited to, damage to customer-provided items, lost profits, or indirect damages.

Dispute Resolution

Disputes will be resolved in accordance with applicable local laws and regulations.

Changes to Terms

Embers reserves the right to modify these Terms and Conditions. Changes will be posted on the Embers website.
